COPYRIGHT LICENSE AGREEMENT (FOR STANDARD PLAN)

I. MODEL OF THE COPYRIGHT LICENSE

The model of the copyright license is PRF (Premium-plan Royalty-free), a brand new model created for the Internet and mobile networks. PRF is specially for Internet-related purposes, including website building, illustrations for social media, illustrations for articles, illustrations for electronic commerce, brand building, brand promotion, etc. The licensee, upon completion of a purchase of a VIP business plan issued by the licensor, has the worldwide, permanent and non-exclusive right of use of the original content on the website for free within the validity on the premise of proper use of the account unless otherwise specified.

II. VALIDITY OF THE COPYRIGHT LICENSE

1. The duration of the use of the licensee’s account is one year.
2. The licensee is allowed to download and use all original content on https://pikbest.com labeled as “for commercial use” for free within the scope stipulated in this copyright license agreement, which is agreed on by both the licensor and the licensee.

III. SCALE OF THE LICENSEE’S BUSINESS ENTITY

The total of the incumbent employees of the licensee’s business entity shall be less than 500.

IV. DETAILS OF THE COPYRIGHT LICENSE

1. General provision. Each piece of the content by the licensor is allowed to be purchased individually by means of extended permissions, where the licensee is allowed to use the purchased content for unlimited times and non-exclusive purposes without limitations on the scope of use. The licensee shall not authorize, sublicense or transfer the purchased content to any third party. The ownerships or IPRs (intellectual property rights) of the content shall be held by the licensor or the ownership holder.
2. Property of the license. The copyright license is for commercial use for business entities.
3. Details of the purposes allowed.
(1) Digital media, including social media, illustrations for websites, music, etc.;
(2) HTML5 pages, electronic mails, electronic postcards, illustrations for Microsoft PowerPoint documents, music, etc.;
(3) images for third-party electronic commerce platforms; and
(4) media purposes, including media playback or live streaming platforms, including television, online videos, movies, etc.
The total of impressions generated via the aforementioned online and media purposes shall be no more than 100,000. Please select an appropriate plan or request a supplementary copyright license.

V. PROHIBITIONS

1. The licensee shall not use the licensed content in approaches that are in breach of the terms and conditions stipulated in this copyright license agreement or beyond the scope stipulated in the terms and conditions stipulated in this copyright license agreement.
2. The licensee shall not share the licensed content with any third party, including but not limited to sharing the purchased content with, or offering the purchased content to any third party by means of digital asset management systems, Internet-based approaches, online and sharable storage services and platforms or any other similar devices for the purpose of sharing or transferring the content.
3. The licensee shall not use the content in inappropriate approaches that are in breach of trademark rights or IPRs (intellectual property rights) of any third party, or produce or try to produce deceptive advertisements or commercials or engage in activities that involve illicit competitions.
4. The licensee shall not use the portraits or figures offensively, including but not limited to the scenarios listed below.
(1) The licensee shall not use the portraits or figures for porn-related purposes or similar scenarios, or dating-related purposes or similar scenarios;
(2) the licensee shall not use the portraits for defamatory, illicit, offensive or unethical purposes; the licensee shall not use the portraits in the content as models with implicit information about unethical or illicit activities attached to the portraits, or attach physical or mental weakness or illness to the portraits in the content; and
(3) the licensee shall not use the portraits in the content for purposes related to sensitive advertisements or commercials, including but not limited to tobacco, medicine, drugs, plastic surgeries, physical recoveries, healthcare products, and audio or video services (e.g. socializing, dating-related and pre-marriage tests, etc.).

VI. OTHER PROVISIONS

1. If the licensee is in breach of the terms and conditions stipulated in Part V, the licensor has the right to terminate the licensee’s right of use of the account and the licensor shall not refund the licensee. The licensee shall bear legal responsibilities and all the loss as a consequence of the breach.
2. Please use your account properly. A built-in anti-fraud system exists for commercial protection concerns and the licensor has the right to suspend the functions related to downloading of the licensee’s account if the anti-fraud system is triggered due to intensive downloads by the licensee.
3. If the content is labeled as “portraits and fonts for reference only” on the licenser’s website, the licensee shall request permissions in written form from the licensor prior to the use of relevant portraits or fonts. Otherwise, the licensor shall not bear any loss generated as a consequence.
4. The licensee, if purchasing the VIP business plans issued by the licensor, agrees on the terms and conditions stipulated in this copyright license agreement, which takes effect upon the date when the licensee purchases a VIP business plan issued by the licensor.
